You are about to access a United States Government (USG) information system that contains Personally Identifiable Information and/or Protected Health Information (PHI). The information possessed, accessed, maintained, and/or disseminated by this system is FOR OFFICIAL USE ONLY and must be protected from improper disclosure in accordance with the Privacy Act of 1974, the Health Insurance Portability and Accountability Act (HIPAA) of 1996 to include its implementing regulations, and ND 55-01

You have an obligation not to disclose any information contained within this system, except for lawful official business reasons in accordance with the Privacy Act (5 U.S. C. § 552a(i) (1)). Any person who engages in willful disclosure of the information contained in this system, in any manner, to any person, entity or agency not entitled to receive it, shall be guilty of a misdemeanor and fined not more than $5,000.

You have an obligation not to create any new record-keeping scheme using the information you access through this USG information system in accordance with the Privacy Act (5 U.S. C. § 552a(i) (2)). Any officer or employee of any agency who willfully creates, uses, or maintains such a system without first meeting the notice requirements of subsection (e) (4) of the Privacy Act shall be guilty of a misdemeanor and fined not more than $5,000.

You have an obligation not to request or obtain any record concerning any individual from any agency under false pretenses in accordance with the Privacy Act (5 U.S . C. § 552a(i) (3)). Any person who willfully does so shall be guilty of a misdemeanor and fined not more than $5,000.

You have an obligation to safeguard PHI in accordance with HIPAA (Pub . L. No. 104 -91 , 42 U.S.C. § 1320d-6) and its implementing regulations (45 C.F . R. Parts 160, 162 , and 164). Failure to do so can result in penalties ranging from $100 to $50,000 per violation (or per record) , with a maximum penal ty of $1.5 million per year (45 C.F.R. Part 164 -Security and Privacy).
